do be relinquished uh Brent Baldwin's here to EMP any questions that might come up but we recommend you conduct the public hearing and then authorize the ordinance relinquishing the easement okay um how many people do we have signed up for public hearing we don't have anybody signed up tonight no signed up for public hearing okay all right well I guess I will close the public hearing and bring it back to council council member list well you can see up in the diagram there's I think at storm water the purple lines have you heard I'm sorry yeah go ahead Yoshi thank you uh my name is Yoshi Ral uh thank you uh members of city council Madame mayor uh members of public and those viewing at home um I'd like to say one thing about this um we don't own this neither publicly nor privately do we own this this uh land that we're talking about here we're stewards of a gift the land that we're talking about here is a gift we're stewards of a gift we neither own it publicly nor privately thank you okay thanks Yoshi go ahead yes so Mr B if I'm correct the purple is the storm water and green I'm going to yes is Wastewater and blue is drinking water that's correct okay so basically we have all three utilities right nearby and there's no reason for us to put another pipe down the middle of the easement therefore I would move we pass the resolution second motion has been made by council member loquist and seconded by council member Huffman this is a resolution it's not a um ordinance so we can
pass this tonight uh upon um an affirmative vote here so all those in favor signify by saying I I opposed exensions recusal motion carries okay that will take us just give me a minute here sorry about that that'll take us to the mayor's report good evening Council city employees members of the community uh it's great to be here this evening and I have a few appointments to lead off marriage report tonight first to um our for approval the first one is to the historic preservation commission and that is I'll be appointing Judy Ford and Leonard Yury to their first terms and that's for Council approval move approval second motion been made by council member Anderson second by council member Huffman any discussions seeing none all those in favor signifi by saying I I opposed extensions recusal motion carries 70 the next matter for council's approval is my appointment to Jamon agasti to the transportation commission for a partial term move approval second motions been made by council member Huffman second by council member cotton any discussion seeing none all those in favor signified by saying I I opposed extensions recusals motion carry 70 thank you next for information I will be appointing Matthew anger to his first partial term Katherine fredman to her first partial term and DJ pra to her first partial term to the Community Development Advisory Board and lastly for appointments I will be reappointing Craig Jewel and Christine Jenkins to their second terms to the tourism
commission and moving on to more General updates um as we Endeavor to provide excellent government in service to our community we acknowledge that sometimes that work is hard The Arc of change can be long uh and there can be a lot of seriousness to the work and there was an event in our Community last week that really brought this home um an incident with a child and um I also wanted to acknowledge that it's important that we celebrate when there's good news as well so inspired by some of the juneth celebration I have picked a theme of good news for the mayor's report this week so good news is that summer weather is coming and that our spray parks are open and they are free they're familyfriendly and and they are spread throughout town so Cornwall Memorial Park Fair Haven Park and Cordata Park all have splash parks available and they use clean fresh water making it safe and fun for everyone right now also wanted to share great news if you have been following Along on our urban forestry plan and some of our quick start actions uh one of those opportunities is in effect right now and that is that we have grants available for treat planting we are seeking Grant applications from nonprofit organizations and other private non-governmental groups to fund tree planting efforts on private property the applications for the Community Tree partnership grant program are due Friday July 12th and you can learn more on the city's website I also wanted to share news about downtown
placemaking and activation and in addition to the suite of actions that we have put in place for downtown the city has ex invested significant resources to promote a beautiful and Lively experience and we just closed an RFP that invited the community to share their big ideas to both enhance aesthetic appeal and brand identity of downtown create a more enjoyable experience that encourages longer stays and increased foot CRA traffic and also to activate our public streets our sidewalks plazas parks and other underutilized spaces ideas that Foster Community connections a sense of belonging and showcase our local talent and cultural diversity and we have $350,000 to award in this round and that is largely created and made possible thanks to local tourism dollars for which we are incredibly grateful and the good news is is that we had more than 40 proposals that made it through minimum calls and I'm very excited about the opportunities that will be forthcoming more good news is that we uh are seeking invitations from the community to name the peer so it has been known as Tilbury Pier Lehi pier and the Olympic cement Pier or just the pier and we are inviting ideas for new names for the iconic Pier that extends into Bellingham Bay from Little squal Park this property was acquired in 2021 thanks to a donation to the city and renovations to the public access will begin later and we invite you on engage Bellingham to share your good ideas for what we should name that here good news on
in terms of funding electrification I wanted to share that we've received word that the city and the county have been awarded more than $1.3 million in Grant support for the installation of electric heat pumps for space and water heating in the homes of low and moderate income residents and small businesses the funding is made possible through Washington's climate commitment act and we are grateful for that Grant also good news is um in terms of the Wacom racial Equity commission I was pleased to join council member skip Williams and other members of the wam racial Equity commission I see at least one other member here tonight for the first and inaugural meeting the vision of the commission is that all Races in wakam County live Thrive and belong for who they are as they are without fear every day and I'm grateful to be part of this essential work and last on the mayor's report is an update on juneth WE honored juneth earlier today with our annual flag racing ceremony featuring heartfelt words and song in the plaza juneth is the oldest known celebration commemorating the ending of slavery in the United States June 19th or juneth is a city state and federal holiday and the city offices are closed except for Public Safety and Emergency Services there are juneth events ongoing throughout our community that honor and celebrate Black joy and freedom for all people and that is the end of mayor's report tonight thank you thank you mayor that'll take us to our uh Council standing
and that is public works and natural resources and that's chaired by council member Hannah Stone thank you president Hamill um so this morning on the public works and natural resources committee I was joined by council members Anderson and Lila Quist we had several items before us this morning the first of which was agenda bill 24154 this was a wash doop presentation on the I5 Meridian fish passage project on State Road 539 so the Washington State Department of Transportation is beginning the design and construction of a fish passage project in the vicinity of the intersection of Interstate 5 and the guide Meridan which is State Road um State Route 539 the fish passage improvements will be made in the Spring Creek and Baker Creek drainages so this morning we were joined by um Megan mosar who is the um wash do project engineer and Chris dichio who is the wash do assistant Regional administor Trader for the Mount Baker area and they shared information with us about the project this was for information and discussion only but just looking at the projections and timelines um obviously there will be some expected disruption during that time but um as to be expected with any large project um they're looking at you know an area of five fish barriers but there will actually be eight installations or projects as a part of um a part of that work and and looking at design work now which won't start actual projects um until later next year 2025 or early 20126 but starting now just to
notify um the public and start those discussions there'll be more information coming forward as we know more about the design and how they're going to deal with the traffic um potential traffic reroute or closed um closures related to access points on I5 during that um during that construction um so that's a big project coming to our area if you want more information I would encourage you to watch the presentation um that we had this morning and again that was just for information and discussion there was no action taken at this time so the next item before us was agenda bill 24155 this was a contract award for the Meridian sewer M this is at I5 to Van Wick EU 184 the Meridian sewer main which runs I5 to Van Wick project will install approximately 177,000 ft of sanitary sewer pipe from approximately 300 ft north of the Birchwood Avenue Meridian Street intersection Northerly to approximately 800 ft north of the Van Wick Road Meridian Street intersection the project will relocate sewers in conflict with a planned fish passage project referenced in the prior um item by the state and accommodate future growth as outlined in the 2016 Wastewater conveyance plan so the city publicly opened three bids on May 29th 2024 and it was Ram Construction General Contractors LLC that was the responsible bidder who submitted the lowest responsive bid of 6,874 5551 including sales tax the engineer estimate is 10,247 18819 so the low bid exceeds the engineers estimate in large part um it was
highlighted due to night work as well as um well the night workor would be happening to try and minimize the traffic disruptions but as a part of that there will also be increased need for traffic control um during the completion of that work and so although there was um significant difference between the engineers estimate and the lowest responsive bid staff was recommending that the city council award the contract to Ram Construction um there was discussion about the importance of this work moving forward and that there was not an expect ation that we would receive a lower bid if this went bad back out um if we rejected all bids and then um sought to renew the bid process um so in spite of that difference um The Hope is is that this project will be able to be completed prior to start of the wash out project which was discussed during the last item um which is projected for 2026 so with that um this a or this this morning we heard from Public Works director Eric Johnston as well as um Eric smatters who is an engineer with the city um and so with that this morning there was a unanimous motion from the committee to recommend approval and this would be to move Award of the contract for the Meridian sewer main EU 184 to Ram Construction General Contractors LLC and I so move second motion's been made by the committee chair and seconded by council member Anderson any further discussion on this item okay all those in favor signify by saying I I I opposed extensions recusals motion
carries Z thank you very much the next item that was on the agenda was agenda bill 24156 this was an ordinance regarding the temporary right of way use permits amending chapter 13.14 of the Bellingham municipal code to wave certain permit requirements for protected speech um this item was pulled from the agenda because it wasn't ready for presentation yet but will be coming back before the council um in an upcoming meeting so stay tuned for that but it was not discussed today so next on our agenda was agenda bill 24157 this is regarding fire station number two um the reof and solar panel installation project so this is B bid number 35 b-224 so the fire station number two re roof and solar panel installation project includes roof replacement solar panel installation and related construction on the existing structure together these improvements will preserve the facility and offset 100% of the building's electrical costs the city publicly opened five bids on May 21st 2024 Cameo construction was the responsive bidder who submitted the lowest responsive bid of $468,500 including any applicable sales or use tax the engineer's estimate in this case was $981,000 um so in this item we came in with the um bid significantly under the estimate so we'll count that as a win we heard from um Public Works director Eric Johnston this morning as well as Joel fun um assistant Public Works director and so this morning there was a unanimous motion from the committee to move to award the contract
for bid number 35 b-224 to commo construction and I so move second motion's been made by the committee chair and seconded by council member lillquist any further discussion on this one seeing none all those in favor signify by saying I I oppose extensions recusals motion carry 70 okay not DP with me yet next this morning we had agenda bill 24158 so this was a contract award for post Point rerro project this is group number two bid number 34 b-224 the postp point re roof project group number two includes roof replacement and related construction on six existing buildings at the post Point wastewater treatment facility the project includes a HVAC upgrades new lighting and ceiling grid repair the city publicly opened three bids on May 29th 2024 in this case high-tech Roofing Inc was the responsive bidder who submitted the lowest responsive bid of 1, 8222 58 including any applicable sales reuse tax the engineer estimate was $1,500,000 and the project includes an apprenticeship hour requirement um and so on this item there was again a unanimous recommendation from the committee to move to award the contract for bid number 34 b-224 to high-tech Roofing Inc and I so move second motion's been made by council member uh stone is the chair and seconded by council member Huffman any further discussion on this seeing none all those in favor signified by saying I I oppose extensions recusals motion carries Z thank you very much so the last item um before us this this morning was agenda
bill 24159 this is regarding adoption of the 2025 to 2030 Transportation Improvement plan state law RCW 35.77 point10 requires cities to annually adopt a comprehensive Transportation program for the ensuing six calendar years the draft 2025 2030 Transportation Improvement program includes projects to construct new facilities for people walking and biking enhance Transit use repair and service streets and sidewalks replace Bridges make roadways safer and more convenient for everyone and facilitate movement of freight subsequent to the public hearing regarding the draft six-year tip held on june3rd 2024 a resolution had been prepared for city council to adopt the 2025 to 2030 tip and staff recommended adoption of the resolution just wanting to note that the draft tip for this upcoming six years includes more than $177 million in plan projects um we were joined once again by Public Works director Eric Johnston and assistant Public Works director Joel fun um and this morning there was a unanimous recommendation to move to adopt the resolution and I so move second motion's been made by the committee chair seconded by council member Williams any discussion seeing none all those in favor signify by saying I I opposed extension recusals motion carry 70 okay and with that there was no further business before the committee so we adjourned and I'll send it back to president Hamill thank you okay uh the next meeting or uh or the next committee rather was Committee of the whole and that
met um at 11:30 out on the flag Plaza I don't have too much to add um beyond what the the mayor had said but I did want to add three things one is that BTV uh that was the first filming and broadcasting live that they've ever done done before so just want to say hats off to um the folks that pulled that off and then um I did want to mention there was an original poem that was read by a person who's here in our audience Jason Mcgill and I just wanted to acknowledge the um the beauty of that poem and um and also my colleague skip Williams uh saying lift every voice and sing which apparently is a very difficult song to sing because it has different ranges things that I don't understand but he he definitely does um but I just wanted to say thanks for everyone that part participated in that including the mayor and um all the other speakers and everyone who attended um this morning so thank you for that um okay I'll go into the main meeting the first item that we had was a presentation on the urban Forest plan and the City of Bellingham is creating a strategic Urban Forest plan to help maintain an uh a healthy and desirable Urban Forest uh through well-coordinated consistent and sustainable long-term Urban Forest management the plan outlines a suite of actions to preserve and enhance the urban Forest to help achieve goals outlined in the climate action plan and the comprehensive plan the plan is based on the aspirational goal of achieving 45% tree canopy coverage within the city in
an equitable fashion as a policy doc document plan creates a basis from which future regulations funding and programs can be based the draft plan is available for public public review the project consultant will uh presented a summary of the community feedback uh and that engagement period was April 15th through May 15th of this year uh trying to summarize um an agenda bill that's literally this long is going to be next to Impossible I would encourage folks if if you're interested in um in this plan and and kind of the policy direction of how this Council and the administration is moving forward uh to to to achieve this Lal goal by 2050 I would encourage you to uh to watch the video should be up tomorrow I think um it's a it was a fairly comprehensive discussion um let's see the next item was an ordinance repealing ordinance uh 2014- 06-03 4 which established a biannual budget for the city of Bellingham there's an ordinance here in the packet um that repeals that ordinance that I just mentioned and Returns the city to an annual budgeting process Finance staff recommended this change to produce a more responsive accurate and transparent uh budget after five banial budget Cycles staff have found the efficiencies provided by budgeting every two years are outweighed by the challenges of forecasting revenues and expenses so far into the future in addition the nature of banial budgets OB skates uh budget challenges and constraints reducing transparency City will uh continue to
produce a 5-year revenue and expense forecast and include 5-year Capital plans in the annual budget to support long-term planning this afternoon the um Committee of the whole uh passed the ordinance and IO move second motion has been made by the um council president and second by council member Huffman all those in favor signify by saying I I opposed extensions recusals motion carry 70 uh let's see I'm try not to skip ahead here just give me a moment okay the next item was on uh has to do with emergency repairs to Electric Avenue Bridge we all know that that bridge is having some challenges uh during a special inspection of the electric avenue bridge on June 3rd 2024 it was discovered that multiple structural elements had substantially degraded result ing in classification to critical failure level this classification of these failures required immediate closure of the bridge Clos the closure of the bridge to vehicle traffic is significant as a significant impact to the transportation network with adverse effects to emergency service providers Bellingham School District wam Transportation Authority and the public in general staff immediately initiated procurement of materials equipment cont contracts to respond to the emergent need to temporarily repair the bridge and restore basic functionality BMC 4.8.1 0 authorizes emergency contracts provided that the city council pass a resolution within two weeks after the contracts are awarded declaring that that that an emergency
existed a proposed or the prop proposed resolution is right here in the packet and this afternoon the committee voted to approve an ISO move second motion's been made by the council president and second by council member Williams any further discussion on this one seeing none all those in favor signified by saying I I oppos abstentions recusals motion carry 70 and then the last item was a long presentation a good presentation uh on promoting a healthy workplace for city employees preventing harassment and ensuing transparency city council had requested a briefing on the safeguards the city of Bellingham has in place to create a healthy and safe workplace for all city employees prevent harassment and and ensure transparent communication between branches of government and that was uh prepared and presented by uh our one of our attorneys Sarah chaplain and our um Human Services director Elizabeth Monahan that presentation was 25 slides worth of material and again um because it was so comprehensive I would I would hate to try to summarize it here in the brief comments that we have tonight um however if you're interested in that and I see a lot of city employees here uh in the in the gallery um I would encourage you to to watch that video and see what that presentation looked like the council had a lot of questions um and so there's a real good conversation that that happened here this this afternoon um old and new business uh council member L quiz yeah I've passed out to council
members um draft document um it's about the possibility of the Bellingham city council sending a letter of support and encouragement to the wam County Council and the wam County Administration with regard to their ongoing discussions about expanding year round shelter capacity for members of our community who are experiencing homelessness um as you'll see from the letter I basically saying that the city council does not express opinions on the specific of The Proposal those are being debated by the county Council and by the ad by the County Administration I'm not really getting into that but I think this is an important moment countywide um we've had a relationship with the uh County as partners sometimes following sometimes leading dealing with the issues to address homelessness um I really want to encourage this this effort um and so I've asked our policy analyst to draft some possible talking points um and if there's interest in going forward uh these talking points would would be turned to a letter which we could consider at our next meeting that would allow us to send it to the County Council prior to their meeting I think on July 9th which is when they're due to take up uh the resolution uh for possible action uh the mayor has already given me some of her excellent points and suggested language I like uh think some language is really good if if there's interest in the council I will move forward on having this letter drafted and um give each and every one of you time
either now or later to to you know suggest other talking points or to maybe ask that some of these be removed or expanded or whatever so at this point I'm looking for support to continue on working this these ideas up into a letter for our next meeting any objections to that go ahead Council mstone so not an objection I guess but just a point of clarification so I know when we're thinking about right the city's role and the Count's role and then interjecting ourselves into those discussions take that you know seriously and so one of the points of clarification I guess I was asking about when it speaks to city council support just some clarification on is that the council's supporting or providing um sort of affirmation for them to go forward and assume the role that they have before them to provide shelter thinking about the watom county having the Department of Health and Community Services right and I think continually during those shelter discussions thinking that the city doesn't have the health department and those issues related to Public Health should be led by the county or is the the support in some way saying that the city will play a role in supporting those efforts and if so I don't think we know what that looks like now and thinking about our budget constraints in this coming you know cycle I'm just curious what you're thinking so let me clarify this is more kind of L of moral support if there's tangible support organizational support Operational Support I'm not
talking about that at this point this is a higher level letter um under the framework in in Washington State counties are required to plan to address homelessness wam county has a plan to end homelessness we don't have a plan but we work under their plan so watom county has a health department and they've been addressing uh some of the issues in homelessness as a Health crisis we don't have any health officials Public Health officials so they are uniquely situated with regard to homelessness which is why I particularly appreciate sort of them assuming their Manel I'm not trying for to I'm not trying to uh indicate that it's their job and not ours I'm just trying to appreciate the fact that they're stepping into that role because they do have a unique uh position to address it as a Health crisis and as a regional issue uh that that is beyond our scope as a city which is why I appreciate what they're doing so I can try to clarify that in the letter would that be helpful good I don't I mean I don't know that it's um necessary I was just curious about the what you saw the purpose of right the letter to be so I think you articulated that well to me it just seems a little bit like you know saying that yes we support you doing your job right I mean not to put it that bluntly but that and so I don't know how that's received right from the other side of the street that's my only well it's it's an issue of active debate over there um I think there's a lack of unanimity of views there
may be eventually a consensus agreement and maybe our support would help them to reach that consensus agreement that's my My Hope sure may I suggest that we um allow Mr liquis to um work with our with Iris notot our policy analyst and then craft something that's a little more in depth this this is the first time we've seen this and it's up here and we're in the middle of a meeting so but I do appreciate the effort not not discounting that at all I think you just need to have more of a like a baked product here for so what I would request though is if there's feedback and suggestions we really need them over the next week or so in the sense to be able to get it into the packet Miss not will have to help me draft that letter before next Tuesday before next Tuesday sure so that's the deadline we're working with if we want to get it before the public as well as before the council okay fair enough okay any other any other uh items for old new okay this afternoon we had um we had a motion to dispose of a previous motion uh regarding converting or or looking at the uh at large position and make possibly making it a four-year term we made a we made a motion City attorney Mariner do we need to um follow that up tonight no I think what you did this afternoon is sufficient okay for staff okay thank you um okay well that that takes us to our executive session I'll make a report real quick here and we'll move on past that so we had four items for executive session the first two were
property potential property Acquisitions both with um Matt stamps one of our attorneys staff provided uh information on a potential Watershed acquisition uh that was for information discussion no action was taken second one potential property acquisition uh that was for information discussion no action was taken there either uh we had potential litigation um the staff provided information on a potential litigation matter and then labor relations this was to discuss collective bargaining strategy with Monahan staff provided information on a labor relations man matter and that was for information and discussion no action was taken consent agenda approval second okay a lot just happened right there um council member Williams U moved approval of the consent agenda I'll give go ahead and give the second to council member hutman um any further discussion on that one seeing none all those in favor signify by saying I I opposed exensions recusals motion carries 70 that brings us to final consideration of ordinances president H are you recused in this item yes I'm recused in this matter so I will not be voting if there is a discussion then I will uh leave the room for the discussion if there's no discussion I'll just stay here andain Fair okay okay agenda Bill 24136 an ordinance amending Bellingham inle code code BMC 20.3 7.33 specifically allowing an increase in height on certain properties within the Fair Haven Urban Village move third and final second Mo uh third and final by
